A special court in Uttar Pradesh’s Ballia district has sentenced a Bangladeshi national to three years of rigorous imprisonment after finding him guilty of obtaining and using forged Indian identity documents, including a fake passport, along with involvement in illegal property transactions. The conviction marks another significant case highlighting concerns over cross-border identity fraud and misuse of official documentation systems.

According to court proceedings, the accused had entered India using fraudulent means and managed to acquire multiple identity documents by allegedly exploiting forged records and assistance from unidentified local contacts. These documents were later used to obtain an Indian passport, which allowed him to travel internationally on multiple occasions, raising serious concerns about security lapses in identity verification mechanisms.

Investigation and Arrest

The case originated after intelligence inputs and a formal complaint led law enforcement agencies to investigate the accused’s background and documentation. Authorities discovered inconsistencies in his identity records and travel history, which prompted a detailed inquiry under provisions of the Indian Penal Code, the Passport Act, and the Foreigners Act.

During the investigation, officials found that the accused had allegedly secured Indian documents using fabricated details. These included identity proofs that enabled him to establish a false citizenship profile. Based on these documents, he was also able to conduct financial and property-related activities, including the illegal registration of land in another Indian state. 

Charges and Trial

Following the completion of the investigation, police submitted a charge sheet detailing multiple offences, including cheating by impersonation, forgery of official documents, and violations under the Foreigners Act. The prosecution argued that the accused had deliberately misused the administrative system to project himself as an Indian citizen.

During the trial, the prosecution presented documentary evidence and witness statements supporting the claim that the accused had used forged identity credentials. The defence, however, attempted to challenge the validity of the evidence, arguing discrepancies in the investigative process.

After examining the material on record, the court concluded that the prosecution had successfully established the charges beyond reasonable doubt.

Court’s Observations and Verdict

The court observed that the deliberate creation and use of forged identity documents posed a serious threat to national security and administrative integrity. It noted that such offences not only undermine the legal framework governing citizenship but also facilitate other unlawful activities, including illegal travel and property acquisition.

Holding the accused guilty, the court sentenced him to three years of rigorous imprisonment. A monetary penalty was also imposed, with a provision for additional imprisonment in case of non-payment of the fine.
