The Calcutta High Court has granted interim protection to Abhishek Banerjee in connection with an FIR registered over remarks allegedly made during a political rally ahead of the elections. The court’s intervention came after the Trinamool Congress leader approached the judiciary seeking relief from coercive action by investigators.
According to court proceedings, the FIR accused Banerjee of making statements during a campaign event that allegedly violated provisions of election-related and criminal laws. The complaint claimed that the remarks could disturb public order and influence the electoral atmosphere. Following the registration of the case, Banerjee moved the High Court challenging the legality of the FIR and seeking protection from arrest.
During the hearing, counsel representing the Trinamool Congress MP argued that the allegations were politically motivated and aimed at targeting opposition leaders during a sensitive electoral period. The legal team contended that the speech in question fell within the ambit of political expression and democratic discourse protected under constitutional guarantees of free speech.
The state’s legal representatives defended the registration of the FIR, maintaining that law enforcement agencies were acting within their authority and in accordance with legal procedures. They submitted before the court that the investigation was still at an initial stage and that the contents of the speech required examination. 
After hearing arguments from both sides, the High Court directed that no coercive action, including arrest, be taken against Banerjee until the next date of hearing. The bench also sought responses from the concerned authorities regarding the circumstances under which the FIR was filed and the allegations contained in the complaint.
The order provides temporary legal relief to the senior Trinamool Congress leader while the court examines the matter in greater detail. Political observers view the development as significant due to the heightened political climate in West Bengal and the continuing legal battles involving leaders from major political parties.
Banerjee, who plays a key role in the Trinamool Congress leadership structure, has frequently accused opposition parties and investigative agencies of using legal mechanisms for political pressure. The latest case has intensified political exchanges between the ruling party in West Bengal and its rivals.
Legal experts note that courts often examine whether speeches made during election campaigns cross the threshold from political criticism into unlawful conduct. Such cases typically involve balancing freedom of expression with concerns related to public order, electoral integrity, and communal harmony.
The matter is expected to return before the High Court for further hearing, where the bench may decide on the continuation of interim protection and the future course of the investigation. Until then, the court’s order effectively prevents any immediate punitive action against Banerjee in the case.
