The Supreme Court on Tuesday declined to cancel the bail granted to Rashtriya Janata Dal (RJD) chief and former Bihar Chief Minister Lalu Prasad Yadav in connection with multiple cases related to the multi-crore fodder scam. The decision comes as a significant legal relief for the veteran politician, whose bail had been challenged before the country’s highest court.

A bench of the Supreme Court dismissed the plea seeking cancellation of Yadav’s bail, observing that it found no valid grounds to interfere with the earlier orders granting him relief. With this ruling, the bail granted to the RJD leader by the Jharkhand High Court remains intact.

Supreme Court Finds No Reason to Interfere

During the hearing, the apex court examined the arguments presented by the petitioner challenging the grant of bail. However, after considering the submissions, the bench concluded that there was no justification for cancelling the relief already extended to Lalu Prasad Yadav.

The court effectively upheld the High Court’s decision, allowing Yadav to continue on bail while legal proceedings in the fodder scam cases continue.

The ruling does not amount to an acquittal or a decision on the merits of the criminal cases. Instead, it only concerns the question of whether the bail granted earlier should be withdrawn.

Background of the Fodder Scam

The fodder scam is one of India’s most prominent corruption cases and involves the alleged fraudulent withdrawal of government funds from the Animal Husbandry Department in undivided Bihar over several years. Investigations revealed that large sums of public money were allegedly siphoned off through fake bills, forged records, and fabricated expenditure related to cattle fodder, medicines, and livestock equipment.

Following the bifurcation of Bihar in 2000, many of the cases came under the jurisdiction of Jharkhand courts because the concerned treasuries are located in the present-day state.

The Central Bureau of Investigation (CBI) investigated the scam, leading to multiple criminal cases against several officials, politicians, and suppliers. 

Cases Against Lalu Prasad Yadav

Lalu Prasad Yadav has faced prosecution in several fodder scam cases linked to different treasury withdrawals. Over the years, he has been convicted in multiple cases and sentenced by special CBI courts.

Despite these convictions, he was granted bail by the Jharkhand High Court after serving a substantial portion of his sentence and considering other legal factors, including his health condition and the period already spent in custody.

The bail orders enabled the veteran politician to remain out of prison while appeals against his convictions continue to be heard.

Challenge to the Bail

The plea before the Supreme Court sought cancellation of Yadav’s bail, arguing that the relief granted by the High Court should be reconsidered. The petitioner requested the apex court to set aside the bail orders and direct that Yadav be taken back into custody.

After evaluating the matter, however, the Supreme Court found no compelling reason to disturb the High Court’s decision.

By dismissing the petition, the court reaffirmed the principle that cancellation of bail requires strong legal grounds and cannot be ordered merely because an application seeking such relief has been filed.

While the Supreme Court’s latest order provides immediate relief to Lalu Prasad Yadav, the criminal proceedings connected to the fodder scam remain ongoing. Appeals against his convictions and other related legal matters will continue to be adjudicated in accordance with the law.

The ruling solely addresses the issue of bail and does not alter the status of the pending appeals or the convictions already recorded by the trial courts.
