On Monday, sixty-three Opposition MPs submitted a notice in the Rajya Sabha to initiate a motion for the removal of high court judge Yashwant Varma, from whose residence burnt bundles of currency notes were discovered following a fire incident in March.
Congress MP Syed Naseer Hussain stated that the notice has been presented to chairman Jagdeep Dhankhar. Indian National Congress merchandise
A similar notice to initiate a motion for the removal of Justice Varma has also been filed by ruling BJP and opposition members in the Lok Sabha.
Hussain remarked, “63 opposition MPs, including those from AAP and INDIA bloc parties, have submitted a notice to the Rajya Sabha chairman for the removal of Justice Varma.”
Although TMC members were absent today, they support the issue and will provide their signatures later, he added.
A motion for the removal of a judge requires the signatures of at least 100 MPs in the Lok Sabha and 50 in the Rajya Sabha.
The motion can be either accepted or rejected by the speaker or chairman of the House.
If the motion is accepted, the speaker or chairman will establish a three-member committee in accordance with the Judges Inquiry Act.
This committee, which will include a senior judge of the Supreme Court, a sitting chief justice of a high court, and a distinguished jurist, will investigate the allegations against Justice Varma and produce a report within three months.
The inquiry report will be presented in Parliament, followed by discussions in both Houses, after which a vote will take place on the motion for the removal of Justice Varma.
Despite Justice Varma’s denial of any misconduct, a Supreme Court-appointed in-house inquiry panel has determined that the judge and his family had either covert or active control over the storeroom where the cash was discovered, indicating serious misconduct warranting his removal.
