HDFC Bank’s CEO and Managing Director, Sashidhar Jagdishan, has taken legal action by approaching the Supreme Court on Thursday in response to an FIR filed against him for allegations of cheating and fraud by the Lilavati Kirtilal Mehta Medical Trust.
Senior advocate Mukul Rohatgi presented the petition to a bench comprising Justices MM Sundresh and K Vinod Chandran, requesting an urgent hearing of the case tomorrow.
Rohatgi pointed out that three judges from the Bombay High Court have recused themselves from the case, leading to delays in its listing.
“A baseless FIR has been filed against the MD and the Bank by the trustees of the Lilavati hospital, who are currently in litigation with another group of trustees. The bank is attempting to recover funds from them. To exert pressure, they have filed an FIR through the Magistrate against the MD. We approached the Bombay High Court, but three benches have recused themselves from the case. The next hearing is set for July 14, which is also tentative. The bank faces daily losses,” the senior advocate stated.
The bench has agreed to hear the plea for quashing the FIR on July 4.
As per the complaint lodged by the Trust, which operates the renowned Lilavati Hospital in Mumbai, Jagdishan is accused of accepting a bribe of Rs 2.05 crore in return for providing financial advice that would enable the Chetan Mehta Group to maintain illegal and undue control over the Trust’s governance.
